Safety & Liability Waiver

REQUIRED: BINGHAM PARTY RENTALS LLC ACKNOWLEDGMENT OF RISK, WAIVER, RELEASE FROM

LIABILITY, AND INDEMNITY AGREEMENT

THIS DOCUMENT MUST BE READ AND SIGNED BY ALL PARTICIPANTS.

It is a legally binding acknowledgment of risk, waiver, release from liability, and indemnity agreement. By signing, you

eliminate the possibility of any future legal action against Bingham Party Rentals LLC and its related entities.

By signing below, you confirm that you have read and understood this agreement and the risks involved. You

acknowledge the posted safety signs and confirm you have watched the Bingham Party Rentals LLC safety video.

You've had the opportunity to ask questions of the staff and inspect the structure, equipment, and areas used. You have

observed others participating and believe you have the physical and mental ability to participate safely.

I hereby affirm that I am eighteen (18) years of age or older and I am signing on my own behalf and on behalf of any

accompanying minors listed below.

I understand that all participants entering the park must purchase a ticket to enter the park, whether or not they intend to play. 

I understand that children 7 and under must be supervised by an adult. I understand that toddlers (ages 3 and

under) may enter free when accompanied by a ticketed guardian, and that the guardian must remain physically with the toddler at all times.

I acknowledge and agree that:

a) Individuals with pre-existing injuries or conditions (including head, neck, back, shoulder, hip, or leg injuries; heart or

lung issues; or pregnancy) should not participate in Bingham Party Rentals LLC activities due to risks such as falls,

impacts, exertion, or trauma.

b) Participation carries risks such as: uneven inflatable surfaces, collisions, equipment malfunction, falls, or contact with

other participants or park infrastructure. Limited lighting conditions may increase these risks.

c) Risks extend to travel to/from the site and to non-participating observers (e.g., those standing nearby or taking

photos).

d) Weather conditions like rain or wind may create unexpected hazards.

e) It is strongly recommended to consult with a doctor before participating-especially when signing for minors.

f) Participants may suffer injuries such as sprains, fractures, or serious trauma due to falls, collisions, or improper

landings.

LIABILITY WAIVER

YOU, ON BEHALF OF YOURSELF AND ANY MINORS FOR WHOM YOU ARE SIGNING, AGREE TO ASSUME FULL

RESPONSIBILITY FOR ANY INJURY RESULTING FROM PARTICIPATION AT BINGHAM PARTY RENTALS LLC.

You understand and accept the risks associated with using inflatable equipment and agree to release Bingham Party

Rentals LLC, its staff, instructors, and agents from liability, including for any alleged negligence. Although the facility is

generally monitored, continuous supervision is not guaranteed and risks cannot be eliminated without altering the

recreational nature of the activities.

By participating, you accept the possibility of injury, illness, or death, and AGREE TO RELEASE AND HOLD

HARMLESS BINGHAM PARTY RENTALS LLC and related entities from any claims resulting from negligence,

omission, or misconduct.

You certify that you are in good health, have not received medical advice to the contrary, and will not participate under

the influence of drugs, alcohol, or impairing medications.

YOU AND ANY MINORS FOR WHOM YOU ARE SIGNING VOLUNTARILY AGREE TO RELEASE, INDEMNIFY, AND

HOLD HARMLESS BINGHAM PARTY RENTALS LLC, including equipment manufacturers and installers, from any legal

claims, including bodily injury, illness, property loss, or death-even if not actively participating. This applies now and in

the future.

In the event of injury or death, you, your heirs, or estate (including the parents/guardians of any minors), agree not to

pursue any legal action or claim against Bingham Party Rentals LLC. This waiver also applies if your own actions injure

others.

SEVERABILITY AND VENUE

This is the only valid agreement between you and Bingham Party Rentals LLC and cannot be altered by its staff or

agents. If any part of this agreement is deemed invalid, the remainder remains enforceable.

This agreement is governed by the laws of the State of Utah. Any legal action shall be brought exclusively in a Utah

court. You waive any objection to this venue.

PHOTO AND MEDIA RELEASE

I consent to Bingham Party Rentals LLC recording and using my image or voice (and those of minors for whom I sign)

via photo, video, or other media. These may be used for advertising or promotional purposes in perpetuity. I waive any

rights or claims related to such use.

I confirm that I fully understand this waiver. I am able to comprehend it in English and do not require translation. I am

legally authorized to sign, and I do so voluntarily and without coercion.
